New York State Senate Passes Bill Outlawing "Revenge Porn"


The New York Senate recently passed legislation criminalizing “revenge porn.” The bill sponsored by Senator Joseph Griffo (R-C-I, Rome), would establish the crime of non-consensual dissemination of sexually explicit images, also known as “revenge porn.”
Senator Griffo said, “In an era of increased text messaging, social networking, and emailing, people in intimate relationships sometimes share pictures with each other, some of which may be sexually explicit in nature. However, recipients of these images do not always keep the images private and have the ability to widely disseminate the photos on the Internet. Posting these photographs online should be a crime because it damages the reputations and potentially the wellbeing of the victims, who are routinely threatened with sexual assault, harassed, or fired from jobs.”

Revenge porn is often committed via the internet, sometimes with disparaging descriptions and identifying details, and in an effort to maximize damage against victims.
New York’s current distribution of unlawful surveillance only governs photographs taken without the subject’s consent. This bill would make it a class A misdemeanor to disseminate photographs that are captured consensually, oftentimes as part of an intimate, private relationship which are later disclosed by an individual without the consent of the individual photographed.
In addition to this measure, the Senate passed a variety of measures to safeguard individuals and families by creating new crimes, increasing penalties, and giving law enforcement necessary tools to combat abuse and exploitation.

How Shark Tank Revived My Writing

After seven books and a lost publishing deal, I considered never writing again. I was moving in a different direction, and at the time that decision felt great. I would no longer obsessively check my Amazon sales ranking to see if there was any significant change. I was free.

I had been writing professionally since 2002, having self-published my first two books before landing a publishing deal. However, by 2011, I had yet to write a breakout novel. I was still an unknown midlist author, and for years that didn’t bother me. There was always the next year and a new book that I had to look forward to, and it was always that book that would break me out of obscurity. Then, there wasn’t a next book. I had lost both my literary agent and my publishing deal with Penguin. I found ways to keep myself motivated and press on. Nothing made me feel more complete than when I was writing. Then, in 2013, I watched my father take his last breath in the hospital where he’d fought for months to stay alive. Suddenly, nothing mattered. I was mad at myself for letting fiction consume so much of my entire life. Mad at myself for chasing a dream that never materialized. All I wanted in that very moment and to this day was for my father to still be alive. 

Prior to my father’s death, a “Shark Tank” episode aired in 2011 that planted the first seed for me to try something different from publishing. I watched as Kim Nelson, the owner of Daisy Cakes, made her pitch to the investors. Once all of the sharks agreed it was the best cake they had ever had, I was Googling her company, ready to order one. With shipping, I paid $75—for a carrot cake. It was the best carrot cake I’d ever had. However, when it was gone, I immediately went on a guilt trip for paying that much for a cake when I could’ve bought a box cake for under $5, and with the money I saved bought a week’s worth of groceries. That didn’t stop me from ordering another one months later, however. The cakes came wonderfully packaged, and I thought to myself, I want to own a business. I want to have something to send out that is wonderfully packaged. I am a creator, and I am going to create something aside from new characters. So I programmed my DVR for “Shark Tank” to make sure I didn’t miss an episode. I felt as if I was learning about business and how to run one, and I was determined to come up with a product that I could sell.

In 2014, a year after my father died, I was just about to launch Coilyz (my new business marketing hair accessories for natural hair). I was in my car in the parking lot at the post office, all set to mail the paperwork to start my corporation when I thought to myself, What am I doing? I thought back to one of Mark Cuban’s quotes that I heard on “Shark Tank.” Don’t start a company unless it’s an obsession and something you love. If you have an exit strategy, it’s not an obsession. I didn’t mail the paperwork because Coilyz wasn’t a business that I loved—writing is my obsession.

Now, I own Rose Colored Books, a publishing company. A book is a product, and I already have everything at home that I need to create more characters, and do so with even more passion than I had in the past. I am not ashamed to say I am an independent author. That means I am in control of every facet of the creative process, which can be very beneficial. At my publishing company, I am an A-list author, and the best part, I don’t have to worry about losing my book deal.

It was a great ride but with all of the dating sites online, it is hard to compete with thousands of sites attempting to reach the singles’ market. Tips for Smart Holiday Shopping - An Encore


During the holidays, many of us will be purchasing gifts for our family, friends and business associates and using debit or credit cards to make these purchases. Most of us will be shopping either online or at brick and mortar establishments. However, with debit and credit card use, comes credit card fraud and identity theft? Because consumers are so preoccupied during this time of the year, individuals may tend to let their guard down when it comes to using their credit card or debit card. Following are some simple tips to safeguard you from credit card fraud and identity theft.

Never give your credit card number to anyone who calls you without verifying his or her identity.

Always keep your PIN (Personal Identification Number) private. Never give it out, and never keep it on you.

Some establishments have been caught adding digits to credit card slips after consumers sign them. For example, you think you are paying $25.00 for an item, but when you look at your credit card receipt, you will see $125.00.

After a purchase, make certain the card you get back is yours.

You should report cards, which have been lost or stolen immediately. Credit card companies can freeze your account and issue you a new card without delay.

Review your monthly statements promptly and carefully for unauthorized purchases.

Merchants, who accept payment by credit card, must also disclose any limitations on the use of that card. Disclosure must be conspicuous at the entrance to the store and in any ads, which indicate the credit card acceptance. New York State law prohibits surcharges on credit card purchases.

Retailers who accept payment by credit card cannot set a minimum purchase amount for credit card use.

Merchants are requesting a valid photo ID if you plan to use a credit card.

If you use a debit card to withdraw money from an ATM machine, make certain you take your receipt with you and review it for accuracy. Never leave or discard the receipt in a public receptacle.

Avoid using ATM machines that are located on public streets or in remote areas. Try to use an ATM machine in a bank lobby during banking hours.

If You are Shopping Online


Never purchase items on sites that do not have the secure icon, usually located at the bottom window at the right side or at the top of the domain address, which will say, “Secure.” The address bar that carries the https is securer than the http prefix.

Try to shop at reputable e-commerce sites. A good clue is to look at the copyright year; if it says © 1999 and the current year is 2017, select another site or check out the company with the Butter Business Bureau. You can also send an email question to the company. If they do not respond within 48 hours, select another site.

Never give your social security number to any site.

If you suspect fraud, contact the Federal Trade Commission at ftc.gov/complaint, and order a copy of your credit report from each of the three national credit agencies and once a year from http://www.annualcreditreport.com
